1. scope

The General Terms and Conditions (hereinafter referred to as “GTC”) apply to all orders placed and contracts concluded (hereinafter referred to as “Order”) via the online store of Muchenberger AG in Bottmingen (hereinafter referred to as “Muchenberger AG”). Muchenberger AG reserves the right to change the GTC. The version of the GTC valid at the time of the order shall apply in each case, which cannot be changed unilaterally for this order.

2. offer

The offer is directed to natural customers with residence or domicile in the legal clientele domiciled in Switzerland. Deliveries are made only to addresses in Switzerland. The offer is valid while it is visible in the online store and/or while stocks last. Price and assortment changes are possible at any time. The images shown in advertisements, brochures, the online store, etc., as well as all information about the products are for illustrative purposes and are not binding. The specific information on the product packaging is decisive.

3rd price

Prices are in Swiss francs, excl. Value Added Tax (VAT). The price in the online store at the time of the order is decisive.

4. order

The presentation of the products in the online store is not a legally binding application, but a non-binding online catalog or a non-binding invitation to the clientele to order the product in the online store. Muchenberger.ch reserves the right to limit the delivery quantities for certain products and not to execute the delivery if the order is exceptionally heavy or voluminous. An order is considered an offer to Muchenberger.ch to conclude a contract.

After submitting the order, the customer automatically receives a confirmation of receipt documenting that the order has been received by Muchenberger.ch. If an order is supplemented, the original order shall be considered as the basis for calculation, however, possible special offers and discounts at the time of supplementation shall not be taken into account.

Muchenberger.ch is free to refuse orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded, in particular there will be no forwarding of the products that cannot be delivered. Temporarily unavailable products cannot be preselected.

5. conclusion of contract

A contract is only concluded when the order is processed in the logistics center of Muchenberger.ch. As soon as the order has been prepared for dispatch at the logistics center, the customer receives an order confirmation by e-mail.

The customer’s delivery address must be in Switzerland.

Delivery costs

The delivery costs depend on the value of the ordered products (minimum order value excl. delivery costs, depots and credits). The delivery costs communicated in the online store apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.

Delivery times

Delivery deadlines will be met as far as possible. Any responsibility for failure to meet delivery deadlines for unforeseeable reasons is rejected. Under no circumstances may the Purchaser derive a claim for damages of any kind from failure to meet the delivery deadline. Exceeding the delivery deadlines does not entitle the customer to cancel the order. Force majeure (war, fire and the like) give both parts the right to cancel the contract.

The delivery time for Decor Walther products is about 1 – 3 weeks. Due to the increased demand, the production facilities are currently overstretched. Therefore, there may be an extended waiting time for individual products.

7. payment variants

Payments must be made in Swiss francs.

Electronic means of payment

Credit card (Visa, Mastercard) and Paypal are accepted as means of payment. In case of payment by credit card as well as debit card, the debit will be made after the order has been processed in the logistics center of Muchenberger AG.

Purchase on account

Before delivery of the order, Muchenberger.ch can carry out a credit check, as the advance performance of Muchenberger.ch is associated with a default risk. Muchenberger.ch can exclude the payment option purchase on account without giving reasons. In the case of purchase on account, the customer must be domiciled or resident in the country of purchase. have their registered office in Switzerland.

Should the Client be in default of payment in whole or in part, all outstanding amounts owed by the Client to Muchenberger.ch under any title shall become immediately due and payable and Muchenberger.ch shall be entitled to claim them immediately. In case of default of payment Muchenberger.ch is not obliged to accept new orders or to fulfill outstanding deliveries.

In the event of default, Muchenberger.ch reserves the right to charge reminder fees and interest on arrears. All expenses incurred in connection with the collection of overdue receivables shall be borne by the customer. In case of unsuccessful reminders, the invoice amounts can be assigned to a company entrusted with the collection. The company entrusted with the collection will claim the outstanding amounts in its own name and for its own account and may charge additional processing fees and interest on arrears from the due date.

Refunds, credits, credit balances

If the customer is entitled to refunds or other credits, these will be credited to the customer’s account and can be used for purchases at Muchenberger.ch. Muchenberger.ch vouchers are in no case saleable or auctionable. Only one voucher can be used per order.

8. return and refund policy

Exchange and return of goods are only possible with the agreement of Muchenberger AG. Goods which Muchenberger AG does not keep in stock or which have been delivered ex works, as well as goods which have been delivered more than one month ago, will not be taken back. Also, used or damaged goods and opened packaging will not be exchanged or returned. Returned goods will be accepted only in perfect condition; they will be credited with a deduction of at least 20% on the invoice prices. Any transport and packaging costs shall be borne by the customer.

9 Applicable court and place of jurisdiction

The legal relationship between Muchenberger.ch and the customer shall be governed by Swiss substantive law, excluding conflict of laws rules and the Vienna Sales Convention. The place of jurisdiction for natural persons is Liestal (BL) or the customer’s place of residence. The exclusive place of jurisdiction for legal entities is Liestal (BL).
